Terms and Conditions

1. Scope
These Terms and Conditions apply to all business relations between 123 Terrassendach (represented by Paul Altmann, Meisericher Str. 59, 56766 Ulmen, and Axel Middelkamp, Auf dem Rohlemer 14, 56567 Neuwied) and the customer. Deviating terms of the customer are not recognised unless we have expressly agreed to them in writing.
2. Quotations and advice
Quotations on this website and in the configurator are subject to change and non-binding. Non-binding advice is for information only and does not create any entitlement to conclude a contract. A contract is formed only upon our express order confirmation or upon delivery or performance.
3. Conclusion of contract
The presentation of our products (canopies, configurator) on the internet does not constitute a legally binding offer but an invitation to submit an offer. By submitting an enquiry, order or configuration you make a non-binding offer. Confirmation of the order by us (e.g. by email or in writing) or performance of the service constitutes conclusion of the contract.
4. Prices and payment
The prices agreed at the time of order or order confirmation apply. All prices are in euros and include statutory VAT unless otherwise stated. Delivery and installation costs are calculated and communicated separately. Payment terms are set out in the order confirmation (e.g. advance payment, invoice, instalments).
5. Delivery and installation
Delivery times and locations are agreed individually. Delivery is from the factory or to your home as agreed. Installation may be offered optionally by certified partners; conditions are agreed separately. We are entitled to make partial deliveries where reasonable for the customer.
6. Retention of title
Goods supplied remain our property until all claims arising from the business relationship have been paid in full. For consumer contracts we retain title until the purchase price has been paid in full.
7. Warranty
Statutory warranty rights apply. We grant a 10-year warranty on our canopies in accordance with our warranty terms. Defects must be reported to us immediately in writing or by email. After the warranty period, claims for damages are excluded unless we acted with intent or gross negligence.
8. Liability
We are liable without limitation for intent and gross negligence; for slight negligence we are liable only in case of breach of essential contractual obligations and only for foreseeable, typically occurring damage. Liability for slight negligence in case of breach of non-essential obligations is excluded. Liability under the German Product Liability Act remains unaffected.
9. Final provisions
The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes is our registered office, insofar as permitted by law. We reserve the right to amend these terms; for contracts already concluded, the terms valid at the time of conclusion apply.
